Enforceability

Should any of these Rules of Use be held to be unenforceable the validity and enforceability of the remaining provisions shall not be affected and the unenforceable provision will be replaced by an enforceable provision which comes closest to the intention underlying the unenforceable provision and which is of similar economic effect. If we fail to exercise any right or remedy available under the Rules of Use such failure does not constitute a waiver of that right or remedy.
